Private college staff in sex case scandal involving a child

Interviews with students conducted by the school, transcripts of which were seen by the Irish Daily Mail, were not given to the gardaí.

And one interview tells how the girl was said to have been ‘pinned up against the locker’.

Gardaí from outside the area have been called in to head up the inquiry. A review of the initial Garda investigation is also under way. The gardaí only became aware of the school interviews after they were sent them by a third party. This prompted the new investigation and a handover of all records from the school.

She also said she was bullied afterward by other students and her alleged attacker.

And in a harrowing letter, written by the girl to be delivered to the then Children’s Minister, she wrote: ‘My peers all believe nothing happened because they believed that no school would allow an accused sex attacker to attend classes. Of course he is there to deny everything but I have no voice. I don’t count and no one hears my side of the story.’

The then 14-year-old Junior Cert student was allegedly sexually assaulted on the grounds of the fee-paying school. She told her parents in late January 2018 and it was reported to the school, gardaí and Tusla days later. Following an initial Garda investigation at the time, which included interviewing a number of students, the Director of Public Prosecutions (DPP) recommended the case not progress, due to ‘insufficient evidence’.

But the school had conducted its own investigation in February 2018. Interviews, seen by this newspaper, with students who were in the same social circle as the boy and the girl, are understood to differ drastically to the statements they gave to gardaí.

An interview with the mother of a student, who was concerned after her daughter told her about the incident, reads: ‘[Girl’s] boyfriend forced himself on her. [Redacted student] determined to ruin her life. He pinned [girl] against locker and groped her.’

The mother stated that her daughter said another female student ‘appeared in corridor’ at the same time, and is believed to have witnessed the incident.

In a separate interview, a student told the teachers that the girl told the boy ‘no’ when he tried to digitally penetrate her. The notes read: ‘[Girl] told her about an incident he tried to go further than she wanted. She said no.’

On the evening of the incident, one student told teachers that she ‘noticed [girl] was upset’ and that the girl told her that she had been digitally penetrated.

One report reads: ‘[Girl] was told this is serious and should tell someone.’ The same interview said ‘[boy] said to [redacted student] that [girl] had exaggerated and forgiven him’, and that ‘they got back together’ at a party.

The Mail understands the alleged victim first confided in a teacher but the incident was played down by the staff member.

One staff member being investigated is still the designated liaison officer for the school with Tusla.

This newspaper sent a series of questions to the school, asking if the staff involved had been disciplined or if they were continuing in their full duties. We also asked what actions the school had taken since the case developed. However, no response was provided despite repeated requests.
