A HOSPITAL patient performed a sex act on himself in front of a young doctor while laughing and smiling at her in a “menacing” manner, it has been alleged.

Andrew Roche (32) is accused of exposing himself and continuing to masturbate despite being asked by the doctor to stop.

Judge Brian O’Shea granted him bail despite garda objections and adjourned the case at Dublin District Court.

Mr Roche, with an address at a guesthouse on Gardiner Street, Dublin 1, is charged with offensive conduct of a sexual nature at Dublin’s Mater Hospital last January 23.

The court heard the accused was attending the hospital and was sent to an observation room.

It was alleged that when the young female doctor entered the room to conduct a psychiatric assessment, the accused began masturbating while looking at her in a “menacing manner”.

The court heard this caused her “severe distress and alarm”.

When she asked him to stop, he continued to expose his erect penis to the doctor and she had to leave the isolation room, the prosecuting garda told the court.


It was further alleged that the accused compounded the doctor’s distress by “laughing and smiling at her in a sinister manner” when she asked him to stop masturbating.

Asked why the accused had been in the hospital’s psychiatric unit, the garda told the judge Mr Roche had presented at the hospital “with psychiatric issues”.

Judge O’Shea said what was alleged to have happened was a very regular event in psychiatric hospitals and was not always associated with a criminal offence.

He said he would be surprised if the doctor in question was a consultant psychiatrist.

The judge said in deciding on bail, he had to consider whether the accused was likely to intimidate a witness, destroy evidence or fail to attend court.

The accused was from Clonmel, Co Tipperary, and had been living in Dublin homeless hostels.

He intended to go back to Tipperary, his solicitor Lorraine Stephens said.

Judge O’Shea granted bail in the accused’s own bond of €100, with no cash required.

Under bail conditions, he must sign on at Clonmel garda station.
