A Garda facing 35 charges, including sexual assault and coercive control of his ex-partner, was placed on the promotions list for sergeant while under investigation.

The garda, who allegedly told his victim he would ‘stick a f***ing knife in her’ if she disrespected him, was charged earlier this month.

The accused garda ultimately had his promotion stopped by Garda Commissioner Drew Harris. A source said: ‘He was promoted to sergeant after the investigation into him had already started.

Two civilian civil servants and a senior garda sit on the panel for sergeant promotions. Once candidates are selected their details are sent to the competitions unit in the Garda’s HR directorate.

‘There was a breakdown in communication somewhere, which has led to an embarrassing situation where the job had listed an accused domestic abuser for promotion,’ a source said.

During a bail hearing at Dublin District Court earlier this month, the alleged victim gave evidence that she fears her ex-boyfriend will kill her, their young son, and himself.

The accused, who is in his early 40s and cannot be identified for legal reasons, was remanded in custody with consent to bail, despite Garda objections. These include two counts of sexual assault, coercive control, assault causing harm, criminal damage, theft, threat to kill, threatening to cause criminal damage, endangerment, and harassment between 2017 and 2020. Further charges relate to offences via telecommunications. Insp. Brennan said the accused is a serving garda with more than 20 years’ service who is currently suspended.

He said he was objecting to bail citing the seriousness of the charges, the strength of the evidence in the case, and fears of witness intimidation.

The inspector said a 250-page statement had been taken from the injured party, a woman in her 40s who has a young son with the accused and is receiving ongoing treatment for a serious illness.

The court heard that more than 60,000 pieces of data had been recovered from the woman’s phone. Insp. The court heard allegations of the accused punching his partner, pulling her hair out by the roots, grabbing her neck and trying to choke her, and kicking her while she was on the ground.

It is alleged he sat on top of her on two separate occasions and told her, ‘Look what I can do to you’ before grabbing her genital area and hurting her.

Insp. Brennan said offensive messages were directed towards the injured party, including threats, degradation, and intimidation.

The court heard the accused allegedly sent a WhatsApp message to his partner in August 2019, warning if she ‘ever disrespects’ him again he would ‘go over to her and stick a f***king knife in her’.

Insp. Brennan said he was objecting to bail over fears of witness interference.

The court heard that the alleged victim had previously made two complaints against the accused but withdrew these after being approached by his friends.

Giving evidence, the complainant said her greatest fear was that her ex-partner ‘will kill me and [their son] and anyone that stops him’
