Gerry “The Monk” Hutch is entitled to conjugal visits while on remand in Spanish custody, the Irish Mirror learned.

The 58-year-old – who appeared in court on Saturday for the first time since his arrest on Thursday – can apply for such a move if he wishes and they can take place once a month.

The visitor in such cases, usually the spouse, must provide proof of their relationship with the lag.

If approved, they can spend time without the supervision of warders for some hours, although there are different rules in various prisons in Spain.

Fugitive Hutch was brought before a Madrid court on Saturday evening where he was remanded in custody.

He had been brought there under an armed convoy at 4am that morning from Malaga.

At the short hearing, which was a closed-off session, he was told of the nature of the
European Arrest Warrant which he was detained on foot of.

His next court appearance could be as early as this week and it is expected that he will indicate that he wants to fight his extradition, which could see him remain in Spain for up to six months.

In that time, Hutch – who is married to Patricia with children, none of whom have involvement in crime – may be visited while on remand in prison under the conjugal visits process.

A source said: “He is entitled to conjugal visits and there are strict processes in place where he has to apply and then the visitor also has to go through a verification process.”

As revealed by the Irish Mirror last week, The Monk was just about to order a meal in a street restaurant when Spanish cops swooped.

At around 7pm on Thursday, the one-time crime lord left the building in which he was hiding, looking forward to dinner in the Costa del Sol sunshine.

Every move he had made for the previous week had been monitored by the elite police unit of the Guardia Civil, called the Central Operational Unit.

Hutch had ordered a drink at an outdoors table not far from the restaurant door and had a menu in his hand when a decision was made to grab him.
