Book of evidence Dave Mahon sent for circuit court trial next month accused of assaulting pensioner (70)

The step-father of missing teenager Amy Fitzpatrick was this morning formally served with a book of evidence in relation to a charge of assault on a pensioner.

Dave Mahon (51) is charged with assaulting the 70-year-old man in Carrick-on-Shannon on August 26 last.

Mr Mahon, of Breffni Crescent in the town, appeared before the local district court this morning in relation to the incident – where he was formally sent forward for trial in the Circuit Court on November 9th.

He was accompanied to court by his wife Audrey, the mother of Amy Fitzpatrick (15) who went missing in Spain in 2008.

State solicitor Noel Farrell, for the Director of Public Prosecutions, said the Director had consented to the accused being returned for trial on the sole charge of assault.

“The book of evidence has been served,” he said before entering the declaration of service with the court.”

The application is for an order sending the accused forward for trial to the next sitting of Carrick on Shannon Circuit Criminal Court on November 9th, 2021.”

Addressing Mahon, who was dressed in a navy jacket and white open top shirt, Judge Deirdre Gearty said she was obliged to give him “what’s called the alibi warning.

“If you intend to rely on the defence of alibi, yourself and or your legal team need to notify the prosecution in 14 days,” she said.

“You have now been served with the book of evidence and the single charge contained therein and on the application of the state, I’m returning you for trial to the next Circuit Court hearing in Carrick on Shannon, dealing with criminal business, which is on 9th day of November 2021.”

Judge Gearty noted that Mahon is currently on bail and said he would continue on bail on the same terms and conditions.

Mahon was required to sign a fresh bail bond on the existing conditions.

Appearing for Mahon, defence counsel Reginald Barrett BL sought legal aid to be assigned to Tony Collier and one junior counsel.

Judge Gearty noted Mr. Collier had already been assigned legal aid and there was no difficulty in assigned legal aid going forward while certifying legal aid for one junior counsel also.

Mahon’s stepdaughter Amy Fitzpatrick (15) went missing on New Year’s Eve in 2007 while the family were living on the Costa del Sol in Spain and remains missing to this day.

No trace of her has been found since that time.
