A married man who accessed child abuse material including an image of bestiality in order to “spice up” his love life has been given a two-year jail sentence.

Warehouse manager, Paul Nolan, pleaded guilty to two counts of possession of child pornography on dates unknown between January 14, 2013 and September 11, 2013 under Section 6 of the Child Pornography and Trafficking Act 1998 at a sitting of Wicklow Circuit Criminal Court.

The court heard Nolan (57) of Sidmonton Place, Bray, Co Wicklow told gardaí after his arrest that he had been “going through an experimental phase” at the time he accessed the child abuse images and was looking to “spice up” his sex life but had since “moved on.”

When questioned by gardaí why he was looking at such material, he replied: “I don’t know why. It did nothing for me.”

The court heard Nolan had got married in 2010 but his wife did not come to Ireland until the following year.

He explained he was looking at the child abuse images “just to jazz it up.”

Nolan, who comes originally from Shankill, Co Dublin, also claimed he knew that distributing child pornography was an offence but did not realise looking at such material was also a crime.

The court heard the discovery of child abuse images on computers and a phone belonging to Nolan came about by accident where he was wrongfully implicated in another Garda investigation on an entirely separate matter.

Detective Garda Gary Collins said the equipment was seized during a search of Nolan’s home on September 11, 2013 but it was not examined by the Garda National Cyber Crime Bureau until 2017.

Det Garda Collins said Nolan stated he had no real interest in looking again at the images as part of the investigation.

The court heard a Garda forensic computer examiner had categorised nine videos and five images including one of a young girl aged 10-12 having her genitals licked by a dog as the most serious type of sexually explicit material.

A further video and 76 images were categorised as moderate in terms of abusive levels.

Under cross-examination by counsel for Nolan, Damien Colgan SC, Det Garda Collins acknowledged that Nolan had not got involved in any distribution of the material but was engaged in chat groups about it.

He also noted that Nolan’s use of computers had been monitored since 2013 and no further concerns had arisen, nor had he come to the attention of gardaí about any other matter.

The court heard Nolan, had no previous convictions and had a good employment record.

A probation report categorised Nolan as being at a moderate risk of reoffending as he had limited empathy on how his actions had contributed to the abuse of children.

Sentencing Nolan, Judge Patrick Quinn said the nature of the offences and the fact that it was not a victimless crime meant the issue of deterrence must weigh heavily in his ruling.

The judge said it was troubling that Nolan had the burden of the prosecution hanging over him for eight years, although nobody was really to blame for the delay.

He sentenced Nolan to four years with the final two years suspended on condition that he engages with the Probation Service on his release and completes the Safer Lives treatment programme for sex offenders.
