​A woman who kicked a garda on the shin while she was being searched was so drunk she did not know what she was doing, a court heard.

Agnieszka Laskowska (43) struck the female garda after she was arrested for hurling abuse at officers who found her intoxicated in a Dublin city centre park.

Judge Cephas Power applied the Probation Act on condition the accused remains under supervision of the Probation Service for two years.

Laskowska, from Brookwood Lodge, Tallaght, pleaded guilty to assaulting a garda and public order offences on October 29 last year.

Dublin District Court heard gardaí on patrol came across Laskowska, who was very unsteady on her feet and when asked her name, she walked away.

When gardaí stopped her, she was slurring, she smelled strongly of alcohol and refused to give her personal details, becoming abusive.

She continued to be abusive when arrested and when she was brought to Store Street garda station, Laskowska reportedly kicked a garda in the shin while she was being searched.

Laskowska had no previous convictions, the court heard.

The accused, who did not remember anything of the incident, would “never behave in that manner sober”, her solicitor Donal Quigley said.

She was not drinking anymore and it would not happen again.

Laskowska was out of work and became homeless when the “rent situation in Dublin caught her unawares,” Mr Quigley said.

She also fell into bad company.

Judge Power said the garda, in a victim impact statement, stated it had made her uneasy completing her tasks in the weeks following the assault.
