Under Article 40.4.2° of the Constitution, a complaint can be made directly to a High Court judge to challenge any unlawful detention. The Court must immediately enquire into the circumstances of your detention, ensuring that your constitutional rights are upheld. Furthermore, under Article 40.4.3°, your body must be brought before the High Court, where the detention will be scrutinized to protect your right to liberty. Article 40.6.1° safeguards your right to freely express your opinions. No one can be detained for peacefully protesting against the government or its policies.
