If you are arrested for peacefully protesting, your rights under the Irish Constitution are your shield. You do not have to be silenced or detained unjustly. Under Article 40.4.2° of the Constitution, a complaint can be made directly to a High Court judge to challenge any unlawful detention. The Court must immediately enquire into the circumstances of your detention, ensuring that your constitutional rights are upheld. Furthermore, under Article 40.4.3°, your body must be brought before the High Court, where the detention will be scrutinized to protect your right to liberty. Article 40.6.1° safeguards your right to freely express your opinions. No one can be detained for peacefully protesting against the government or its policies. Your freedom to speak out is fundamental and should never be compromised.
