On 29 September 2023 Carey was charged with a number of counts of deception and forgery. It is alleged that Carey falsely stated he had cancer to induce people to give him money. He is accused of 21 fraud and forgery offences against 25 people over an eight-year period. His trial is due to start on 2 July 2025.
